Snack food manufacturing plant located in Ate, Vitarte. We managed to have a zoning change approved, as required for the performance of the plant´s operations. We also obtained the land development authorization for industrial purposes and obtained all municipal authorizations – Construction Permit and Operating Permit – required to start operations.

 

Friesland del Perú S.A.

Milk and dairy product processing plant: We managed to have different municipal administrative authorities issue favorable advisory opinions for the performance of operations. These opinions were required because the land where the plant is located is classified as agriindustrial land and has not been annexed to the urban area. These favorable advisory opinions allowed us to obtain the Construction and Operating Permits with which our client can currently operate.

 

Eugenio Cogorno Molino Excelsior S.A.

Expropriation of land belonging to a noodle manufacturing plant: “Corporación de Desarrollo de Lima y Callao”, CORDELICA, gave our client notice of its decision to expropriate part of the industrial plant, located on the corner of Av. Marina and Av. Venezuela, Callao, specifically an area of 19 linear meters all around the plant, in order to expand Av. Venezuela. A series of motions were filed, which made CORDELICA reduce the area subject matter of the expropriation measure to 9.40 linear meters. We managed to have CORDELICA refrain from impacting our client´s plot of land, at least during the first stage of the road expansion project.

 

Bristol Myers Squibb Perú S.A.

Accusation filed by ESSALUD with CONSUCODE to disqualify the company and prevent it from participating as bidder in the bidding processes called by the State, arguing that it had allegedly filed a false affidavit in a Public Bidding Process called by said entity. We obtained a favorable resolution supporting all the defense arguments put forward by our client.

 

Alimentos Procesados S.A.

An accusation filed by the National Health Institute with CONSUCODE to disqualify the company and prevent it from participating as bidder and contractor in the bidding processes called by the State, arguing that it had failed to comply, without justified reasons, with the terms of a contract signed with said entity: We obtained a favorable resolution supporting all the defense arguments put forward by our client.

Defense in relation to the objection filed against the contract awarded under Public Competitive Bidding Process N° 010-ESSALUD-99, for a reference value of S/. 1,158.750.00: We managed to have the State Contracts and Purchasing Court issue a favorable resolution that allowed our client to keep the contract awarded to it and thus fully implement the contract it had signed with the Social Health Insurance.

Defense in connection with the Order issued by the Municipality of Santiago de Surco for the demolition of the sixth floor of the San Pablo clinic, located at Av. El Polo: We managed to have the Lima Municipality issue a favorable resolution, revoking the demolition order issued by the district municipality and ordering the regularization of the construction in favor of our client.

Tax collection process followed by the Provincial Municipality of Callao, for approximately US $ 200,000.00: By filing a claim with the municipality, we managed to reduce the debt by approximately 50%, but we must still file an appeal with the Tax Court.
