The main legal services in the field of Intellectual Property are:

a. Trademark Control and Oversight
Our Firm has internally developed a specialized software, which we have called “TRADEMARK CONTROL AND OVERSIGHT SYSTEM” (SCVM), which is aimed at keeping a detailed and automated control of our clients’ trademarks, including trademarks for which registration applications are filed with the Peruvian Trademark Office, in such a way that we are in a capacity to protect the former against third-party infringements or their eventual expiration.

Through the SCVM, we compare the trademark registration applications filed in our country with our clients’ trademarks. In this way, we can detect any eventual similarity that may infringe our clients’ industrial property rights and, if applicable, file in due course the pertinent legal actions. Our clients receive this information through our report called “ALERTA DE OPOSICION” (Opposition Warning)

Additionally, through the SCVM system, we can keep our clients informed on a monthly basis of the filing of trademark registration applications related to their field of business, for them to be aware of the market registration applications filed in relation to the class of products or services they may be interested in.

Apart from and together with the SCVM, we have developed a novel program that we have called “IP SOFT SYSTEM”, through which our clients can gain access, from their own offices, to consolidated information on their trademark portfolio. This program also provides access to the trademarks published in the Official Bulletin published in.

b. Monthly Report on Publications and Procedures Underway
Every month, our clients receive a report issued by our Intellectual Property Practice Group, where we inform them about the current status of each and all of their ongoing procedures. A list of trademark registration applications filed in Peru during the last month, related to the company’s field of business, is attached to said report.

c. International Administration of the Trademark Portfolio
Due to the growth of exports in Peru, our Intellectual Property Practice Group has established a contact network with different intellectual property agents worldwide in order to provide our clients with international advice in this field.

This service is aimed at making it easier for our clients to protect their intellectual property rights in the country or in the countries where they may wish to start commercial activities. In this way, our clients may bring their products or services to any country, knowing for certain that they will not be exposed to border measures that prevent the entry of their products or services or to accusations for infringing intellectual property rights once they enter said markets.

d. Audits on Registration and the Use of Trademarks
Registration Audits
Our legal team conducts a preliminary though full evaluation of the clients’ industrial property rights, supported by automated registration searches and physical reviews of dockets at the Peruvian Trademark Office.

After completing this evaluation, the client receives a report with all issues detected during the investigation. The information is then entered onto our system so that we may take the corresponding control and supervision action.

Audits regarding the Use of Trademarks
Clients that have a broad portfolio of trademarks and usually advertise their products and/or services through pamphlets, catalogs, magazines, or brochures send said documents to the Firm for us to detect whether the trademarks or commercial slogans publicized therein are duly registered. At the end of the evaluation, the client receives a report with the names and phrases that are not registered, for it to decide whether or not it is interested in starting the necessary registration procedure with the Peruvian Trademark Office.

e. Attaché Service
Our Firm assigns a regular and a deputy lawyer to each client, to manage its industrial property portfolio. The idea is to have our lawyers become familiar with the trademarks, patents, industrial designs or utility models of the client and detect any sign of infringement by third parties.

f. Procedures
Our legal team is fully capable of planning our clients’ Industrial Property defense strategies, and of starting and successfully completing all kinds of procedures related to these issues with the competent administrative and judicial authorities in the country.

g. Advisory services

a. Advisory services
We answer any inquiry our clients may have regarding copyright issues. We also provide advice on the preparation and/or review of different copyright assignment or license contracts, including the collection of copyright fees by collective management entities.

b. Procedures
Our Copyrights Practice Group can handle the following procedures: search for antecedents, registration of works, infringement accusations.

As part of the infringement accusations, we carry out, in coordination with the competent authorities, inspection visits to gather evidence and obtain the immobilization, confiscation or seizure of infringing products.

The Intellectual Property Practice Group is comprised of a team of lawyers with broad experience in the fight against piracy and product forgery.

Our legal team is supported by private investigators that provide information about the different clandestine markets and reproduction facilities, including illegal imports and exports.

Our services include the design of a strategy to jointly cope, both on a retail and wholesale basis, with piracy and product forgery in order to discourage this illegal activity.

The actions we may take include the filing of criminal proceedings with the different judicial authorities or the filing of administrative actions with INDECOPI.

Anti-piracy campaigns can include press coverage, if so required by the client.

Our Firm provides domain name services for the registration of domain names under any country-code Top Level Domain (ccTLD) or Generic Top Level Domain (gTLD).

If ccTLD and gTLD administration policies allow the filing of oppositions against registration applications or the filing of conflict resolution procedures, our Firm can represent the holders of intellectual property rights that need to file any such procedure against domain name applicants or holders that infringe any of their rights.

Our Firm provides advice on the sanitary regulation of pharmaceutical and related products; cosmetics; food and beverages; and agro-chemical products.

a. Management of Sanitary Registration Portfolios
A group of expert lawyers and chemical pharmacists are in a capacity to thoroughly manage sanitary registration portfolios.

We take the necessary steps to obtain and renew sanitary registrations, undertake new activities, such as the establishment of pharmaceutical facilities, obtain certificates evidencing good storage practices, stock depletion, review of labels and arts, etc.

b. Specialized software
Software especially designed to control and oversee sanitary registrations, renewals, extensions, etc. is available to our clients.
